can my dad claim me as a dependant even though I only lived with him for 5 mo.?

last year I had to move in with my dad for 5 months until I could get back on my feet again. This was the only time in my life I have ever lived with him also, but after I had moved back out I filed for my rebate electronically as an independant and I was notified that I would be penelized because someone had already claimed me as a dependant (which has to be my dad). I can't afford for him to be stealing away my economic stimulus....can he do this?

As far as I know he can't. In order to claim someone they have to have lived with you for 6 months and you provided 50% or more of their support. Don't quote me cause I could be wrong, but that's how I alwasy made it out to be.

Your dad is not stealing it but claimed you as a dependent at the time you were living with him. You don't say if you paid rent while living with your dad, you could consider it a payment to him if that was the case, I mean your dad did help you out in this situation.



However, if you put in your fair share of the rent money and paid for your own groceries and helped to pay utilities during the time you were there, then you should approach your father to ask about getting half that refund.

If you are under age 19 or under age 24 and a full-time student, and were away at school for more than one month, then your father could claim you as a dependent as long as you did not support yourself.



If you were age 24 or older, or age 19 or older and not a student, then your father can claim you as long as he supported you and you had income less than $3,400.



At any age, if you supported yourself, you cannot be claimed as a dependent.



So, if you cannot be claimed as a dependent, then what you need to do is resubmit your return by mail if it was never filed, or submit an amendment claiming yourself if you filed without claiming yourself. The IRS will sort it out.

actually he can't legaly do that,you have to live with him 6 months or more for him to be able to claim you,more info on www.irs.gov. i was in the same situation years ago,a parent can only claim a child if he/she has the child for 6 months and over.
