Tax Topic 151, Your Appeal Rights... what the hell is going on this year? i claimed my two nephews like i did last year i also got a stimulus in the mail...the only thing diffrent this year is i got laid off back in july and i have been collecting unemployment since...why would i be under review???? i cant find anything on my taxes this year i paid my 1099 for the unemployment and i have the proof of the kids.has any one got this letter yet???? oh and no money has come to my acct yet it was do in the bank as of yesterday...

It probably means that there was an error the computer found, now they are having a person look into it. The problem could be that someone else tried to claim your nephews like the parents. Or it could be just that they are looking heavily into unemployment since with so many there are concerns that people might fudge this. If all your information is correct and matches your documents, there shouldn't be a problem other then it will take a little longer to get your refund. Atleast you got this notice. When they did mine, I just got told there was a problem. I was 10 times worried then, and we found out it was because I could be claimed by my mom and H&R block just assumed I was too old to be able to be claimed by my mom. I was like, he saw my job was a student worker at college. lol

This is the standard answer. They are telling you that they got your taxes and they are reviewing them. This is done by a computer and they are looking for math errors, income not reported, incorrect SSN's, etc. If all comes out fine then that will change to a message saying you are scheduled for refund and anticipated date. But if they find errors it could change. (Assuming you are getting refund).

So nothing to worry about, this is the standard response. I got the same message and it was different from last year. They actually softened the message a bit but until you understand the process it is a little unsettling,

Also, don't get caught up in the hype about delayed refunds. The IRS is ahead of schedule for Dir. Deposit. All of the post I have seen have been from people that filed their taxes early (before 2//1). The tax code was not complete when they filed and the IRS could not process these until that time. Then someone asked the question "If the code was not complete, how could they file their taxes?" So many of them got an automatic review that increased the delay.

Most likely it's due to claiming your nephews. This is a very common fraud issue especially when the EIC is involved. The IRS is monitoring these much more closely because of fraudulent claims in past years by many taxpayers.



When claiming nieces and nephews the IRS will want to see proof of the family relationship. This can require a small sheaf of birth certificates so get those ready.



They will also need to see proof that they lived in your home for more than six months. School records, medical records, church records, leases showing them as occupants and statements from disinterested parties with actual knowledge of the living arrangements can all help to substantiate that.



Gather these records and have them ready when the IRS contacts you for proof. This will expedite the process.



There's not much that you can do to speed things up aside from being ready to supply the proof to the IRS when they ask. They may send you a partial refund of any excess tax withholdings while they review the remainder of your claim.

Dear E: My guess is the nephews. You will probably have to show proof they live with you with school records or doctors records and that you provide over half their support. Did you include the un employment income on your return? Your appeal rights is a sentence normally included when the IRS is changing your refund and you can either agree with their determination or appeal it and provide proof that their conclusion is wrong. The IRS is on a kick of determining the proper person claims children.

You have to ask yourself, do you have the right to claim your nephews? Because if you don't have the right to claim them, I have to tell you,you are in trouble. They are going to make you prove that you are the custodial person of those two boys. If you can't prove that, they are going to make you pay that money back, and you are going to be denied your EIC for xt couple of years. Now since you are being reviewed, you need to know that they are going to review you next year too. Just cause they reviewing you doesn't mean you did something wrong, it just be a random thing they do. But if you doing some shady things like claiming kids that are not yours unless you are they legal gaurdian, you are in trouble. My husband and I went through the same thing over our own biological children, the difference is, they would give us our money any way, because we proved that they were ours. They reviewed us for 2 years, they tried to review us a third year, but I said enough was enough. I got a advocate, and she straightened it out. She said that there was no reason for them to keep reviewing us each year, cause everything was the same each year. She took the red flag off our name. We havn't had a problem since then, and they gave us our earned income credit back all the way to 2004. If you are leagally the kids gaurdian then you have nothing to worry about. Just send in your documentation of everything they ask for, and you would be alright. Tip: when you do send in your proof, fax your proof, it will go directly to the examiner that is on your case, and it will cut your process time down alot. They will give you a fax number on your next letter they will be sending you, giving you a choice to mail your information, or fax it. I always faxed mine. Good luck. Everything will work out.

After several years of not doing intensive reviews, the IRS is back in swing checking any claim of "nieces and nephews" as dependents for EIC purposes. Wait for the letter requesting doc and then send it in.

Sometmes the gvmnt just picks people randomly. Also, are you sure no one else has claimed your nephews? If they are on more than one tax form, then there will be a review.
