My husband in a citizen of the United Kingdom, and I am a US citizen. We live in the UK. We were married two years, but I'm uncertain as to whether I should file my 2011 taxes as single or married. This is because we are married though a same-sex civil partnership here in the UK. As I understand it, the Federal government doesn't recognise this type of partnership and neither does my state (NC). So does this mean I should file single?

As the United States does not recognize same sex marriages, unless you live in a state which recognizes same sex marriages as a bona fide marriage you will need to file as "Single".

Married for FIT income tax man and woman legally married on the last day of the tax year for the 1040 income tax return purposes.

And you can also have some community property rules that you might have to follow for your situation at this time in your life BUT since NC does not recognize it this may NOT be a problem.

So your fining status would have to be as a single taxpayer for the tax year in question.

Hope that you find the above enclosed information useful. 06/09/2012

For federal and NC taxes, file as single. If you have to file in other states, then check their rules. California, for example, often requires same-sex partners to file their California state taxes differently from their federal taxes.

There’s no selection for the sort of guy or woman to report as “unmarried.” What might inspire somebody to attempt to report utilising unmarried status in this occasion? maximum probable, they suspect that doing so will enable them to pay decrease taxes. If 2 contributors of a pair have very distinctive earning, to illustrate, it’s probable that they might owe decrease complete taxes in the event that they might each and every report a unmarried return. in the event that they did this, they’d be committing tax fraud. there are countless blunders that a tax preparer could make, yet this one is definitely inexcusable. A preparer who supplies the sort of advice might desire to somewhat be smacked with a rolled-up newspaper.
